Dan Hotels Corporation Affiliate Program – General Terms and Conditions
This Agreement contains the complete terms and conditions that apply to an individual's
or entity's participation in the Dan Hotels Affiliate Program. By signing up to
be an Affiliate in the Dan Hotels Corporation Affiliate Program (“The Program”) you agree to be bound by the following terms and conditions (“Terms of Service”).
As used in these Terms of Service, "you" means the applicant.
Dan Hotels Corporation (“Dan Hotels”) reserves the right to update and change the
Terms of Service from time to time without notice. in case that the terms of service
has been updated or changed, Any participating in the program after the update or
change will be bound by the current version of the term of service after the update
or change.
Violation of any of the terms below will result in the immediate termination of
your participation in the program, including your account, without derogating from
any other remedy or relief Dan Hotels might have in accordance to any law and/or
contract. In addition, all outstanding affiliate commission payments earned during
the violation will be forfeiture.
You agree to use the Program at your own risk. Dan Hotels does not have any responsibility
for
any damage that you incur as a result of your participation in the
program.
As the affiliate web site owner you declare that you are aware that:
1.
Dan Hotels is a company that deals in tourism/hospitality.
2.
Dan Hotels web site is offering a reservation system that is easily accessed and
friendly to surfers. The web site offers special rates from time to time
that the affiliate web site can publish on its site.
3.
Dan Hotels Affiliate program is operated exclusively by GoLinks Internet Marketing
Ltd. ("GoLinks"). All payments of commissions to you will be made by GoLinks, and
in condition that GoLinks has received the relevant payment from Dan Hotels in prior
to that. You are not entitled to any payment directly from Dan Hotels.
4.
Dan Hotels is not obligated to accept all reservations received through the affiliate
program, and these terms of service do not obligate Dan Hotels to do so. Dan Hotels
has the right to choose which reservations to accept, under its own exclusive consideration.
5.
You agree that if a potential customer contacts Dan Hotels through the Dan Hotels
web site after using the link from a number of affiliate sites, the first web site
that he visited will be entitled to the commission.
6.
Dan Hotels, through GoLinks, is obligated to pay the commissions to the affiliate
web sites and only if the following conditions exists:
a.
The link was working and active in the day that the reservation was booked.
b.
The customer that booked the reservations contacted Dan Hotels’ web site (“www.danhotels.com”)
through the link in your web site, and a cookie was placed by the affiliate program
system on his computer.
c.
The reservation was booked completely by Internet.
d.
The customer completed the reservation in www.danhotels.com web site according
to its terms.
e.
The reservation that was made in Dan Hotels’ web site was fully paid and consumed.
7.
You agree that if a potential customer had entered the Dan Hotels web site in a
way that does not allow the affiliation system to place a cookie on the customer’s
computer; you will not be entitled to receive any commission for his reservation.
8.
During the period of your participation in the program, Dan Hotels grants you the
right to use its trade mark and name. Using Dan Hotels name is limited to the link
in your web site. The use of Dan Hotels trade mark is limited to a banner and/or
text link and/or any other marketing materials provided by the program placed in
your website and containing the link to Dan Hotels’ website, and will be made only
after approved in advance by Dan Hotels.
9.
Each party will be able to terminate the affiliate web site participation in the
program at any time, for any reason and without having to specify the cause, by giving
a written notice.
10.
Affiliate commission will be paid by the Affiliate Program operator - GoLinks - to you
within 30 days from the check out date of each reservation, which was fully paid
and utilized at the time of the payment.
11.
The commission will be paid against an Invoice
12.
The commission will be paid via check or wire transfer to you on condition that
all the necessary details were provided to the program operator (GoLinks) and that
the amount due to pay is at list $100 (One Hundred United States dollars).
Any commission smaller than $100 that you will be entitled to receive will be credited
to you and accumulated until reaching at least $100.
13.
Dan Hotels will not pay commission on a reservation that will turn to a No Show
or reservations that was cancelled.
14.
In the event that a
reservation is placed via
DanHotels’ website for a
period of over 28 days, or if a reservation for a shorter period will be later extended
to above 28 days, Dan Hotels Affiliation Program will calculate

Details of reservations
made by you or any other statistical data presented by the affiliation program
system to you is for your convenience only and does not obligate
DanHotels
16.
Neither party is entitled
to transfer its rights according to this agreement to any third party.
17.
You are obligated to provide Dan
Hotels complete
details of your company, to include the full name of the owner and company
number, address and contact numbers, bank account and/or other payment details immediately
after you join the program.
18.
The program including these Terms of Service does not constitute any partnership
between Dan Hotels and You.
19.
Immediately
after the conclusion of your participation in the program according to these
Terms of Service You are obligated to completely remove Dan Hotels name, trademarks
and any other marketing material provided to you from your website, and to cease
doing any use in them.
20.
You agree that all creation rights and intellectual property rights, of any kind,
in the program, in the content, design, trademarks, brand name etc involved with
it or that are shown on Dan Hotels website belong exclusively to Dan Hotels. You
agree not to make any use in these rights other than for the program
and only during the
period of your participation in it according to these Terms of Service.
21.
The right to place the link to Dan Hotels web site earned according to these Terms
of Service is personal and limited to your web site only. You are not allowed to
place the link and/or use Dan Hotels name and/or trademark on other web sites that
you own. You are not allowed to offer Dan Hotels services is other web sites or
to accept reservations from them.
22.
You
agree
to retain confidential information that is related to the program,
and not to expose it to any third party.
23.
You commit not to violate any law with your actions and operations related to your
participation in the program.
24.
You are obligated to send to Dan Hotels any message related to this agreement by
facsimile or registered mail only.
25.
Dan Hotels is not obligated to operate its website at any time.
26.
You
are
obligated not to include on your website material containing any of the following:
violence; gambling; sex and pornography; illegal actions; violations of
intellectual property rights.
